BORDC-Tacoma appeals Northwest Detention Center expansion permit The Tacoma Bill of Rights Defense Committee is appealing an environmental Determination of Non-Significance (DNS) issued by the City of Tacoma for an expansion of the privately owned, privately operated Northwest Detention Center (NWDC). “Faulty documents, errors, and misstatements have resulted in a bad decision to approve this expansion”, said Tim Smith, chairperson of the committee. The expansion of the NWDC, located at 1623 East “J” Street on the Tacoma Tar Pits EPA Superfund site, will provide housing for 575 more detained citizens from other countries increasing the total bed-space to 1575, and increasing the floor space to 104,000 square feet Smith said. “The City has pretty much taken every effort to exclude citizen input from the expansion approval process. At this point and time we can only appeal the DNS issued by the City on Nov 14. So the appeal is currently the last act in a failing attempt to provide input”, said Smith. The appeal and supporting documents were filed by facsimile on Friday and delivered on Monday morning to the City Clerk’s office. "We don’t want to take any chances. No excuses for not receiving the appeal in a timely manner or improper format”, Smith said. “This action comes as part of an overall campaign to halt the expansion. Following consultation this week with a variety of experts in labor, the environment, government contracting and local development law, the decision was made to pursue this appeal as part of the overall strategy”, Smith said. “This is a public safety issue and always has been. The City of Tacoma, as the lead agency for this proposal must insure that development protects not only the persons living and working in the building, but also doesn’t create a safety hazard. The poor staff work associated with this proposal creates a liability for the taxpayer that could be avoided or mitigated with good information and factual supporting documents. We will show in our appeal what these errors and omissions are and we are asking the City to stop any further action until this more accurate information is included and considered”, Smith stated. According to an article by Mark Jensen on the United for Peace of Pierce County’s website “On November 23 a huge auger and a pile driver were photographed behind the NW Detention Center, despite the fact that no land use notice or building permit, Smith tells us, has been issued. At 9:30 a.m. on Tuesday November 25 I drove by and saw the pile driver in operation behind the NWDC. ‘This violates the covenant between the owners and the State of Washington,’ Smith says. ‘The auger disturbs the groundwater and contaminated soils, bringing both to the surface’ — an important matter, because the NW Detention Center is sited at a location where significant quantities of toxic sediment were left on-site — capped, not removed. A virulently noxious stew of toxic chemicals is marinating in the earth beneath the Northwest Detention Center, so it's not a good place to bring in an auger and a pile driver. I'll bet Tacoma stands to make quite a bit of money on this I.C.E. expansion project, at least that would explain the efforts to expedite the process without regard for public opinion or criticism. Plus, why should the Federal Government have all the fun in this brave new world of human rights violations with their snazzy detention centers like the one at Gitmo? Heck, there's money to go around and confused foreigners to push around, fun to be had by all. No wonder Tacoma wants to get in on the act. Way to keep an eye and ear out, Tacoma's lucky to have you. |
